These Terms apply to the Get In and Handle services purchased through dutchhrbestie.com or another checkout operated by Dutch HR Bestie.
1. About Dutch HR Bestie
Dutch HR Bestie provides independent HR-side guidance for international professionals dealing with the Dutch labour market and Dutch workplace situations.
The services provide practical HR interpretation, analysis and guidance based on the information supplied by the client.
Dutch HR Bestie is not a law firm, immigration adviser, recruitment agency, medical provider or representative of the client’s employer.
The services are available only to clients aged 18 or older.
International clients may purchase a service where their question or situation relates to working in, applying for work in, or dealing with an employment situation connected to the Netherlands.
2. The services
Dutch HR Bestie currently offers two consumer services: Get In and Handle.
The exact price, main characteristics and scope of the service are shown on the relevant product page before purchase. Those product-specific details form part of the agreement.
Get In
Get In is an asynchronous HR-side job-search review. A Get In review may include:
- up to three CV versions;
- one LinkedIn profile;
- up to three cover letters; and
- up to five relevant vacancies.
The deliverable is a personalised PDF report containing Dutch HR-side observations, analysis, priorities and recommended next steps.
Get In does not include:
- a complete CV or cover-letter rewrite;
- recruitment or job placement;
- applying for jobs on the client’s behalf;
- a video or telephone consultation;
- immigration advice;
- legal advice; or
- follow-up questions after delivery.
Additional or materially different work requires a separate agreement.
Handle
Handle is an asynchronous HR-side analysis for a Dutch workplace or employment situation that requires broader context. Examples may include situations involving:
- a manager or HR department;
- workplace communication or escalation;
- performance concerns or a PIP;
- sick-leave processes;
- an employment offer;
- salary or benefits;
- a contract or workplace process;
- a difficult workplace conversation; or
- correspondence or documents received from an employer.
The client may provide the documents reasonably necessary to understand the situation. The deliverable is a personalised PDF report containing an independent HR-side interpretation of the situation, relevant observations, practical considerations, questions to consider and recommended next steps.
One clarification or follow-up question relating directly to the delivered report is included. It must be submitted within 14 days after the report is delivered.
A follow-up question does not include analysis of materially new circumstances, newly received substantive documents or a new issue. Such work may require a new order.
Handle does not include:
- a video or telephone consultation;
- legal advice or legal representation;
- immigration advice;
- medical advice; or
- representation in communications or negotiations with an employer or another party.
3. No legal, immigration or medical advice
Dutch HR Bestie provides HR and workplace guidance only.
Where a situation requires a legal determination — for example concerning enforceability, legal entitlement, discrimination claims, formal dismissal proceedings or representation — Dutch HR Bestie may recommend that the client consults an employment lawyer, union, legal insurer or another appropriately qualified professional.
Dutch HR Bestie may explain HR processes and practical workplace context, but does not provide a binding legal interpretation.
The same applies to immigration and medical matters.
If, before substantive work starts, Dutch HR Bestie concludes that another professional is clearly more appropriate for the client’s request, Dutch HR Bestie may decline the assignment and refund the amount paid.
If this becomes apparent after part of the work has already been reasonably performed, Dutch HR Bestie may charge a reasonable amount for the work already carried out and refund the remaining balance.
4. Formation of the agreement
The agreement is formed when the client completes the purchase and payment is accepted, unless Dutch HR Bestie subsequently determines during initial triage that the requested service cannot reasonably or lawfully be provided.
Before completing payment, the client must have access to these Terms & Conditions and must confirm acceptance of them.
Acceptance of the Terms & Conditions does not by itself remove any mandatory consumer rights.
Where the client asks Dutch HR Bestie to begin providing the service during the statutory withdrawal period, separate express consent will be requested as described in Article 8.
5. Prices and payment
Consumer prices displayed by Dutch HR Bestie are total consumer prices and include VAT where legally applicable.
Payment is due in full before the service starts and is processed through the payment provider shown at checkout, currently Stripe.
Dutch HR Bestie does not receive or store the client’s full payment-card details.
If a client purchases the wrong service, Dutch HR Bestie will, where reasonably possible, identify this before substantive work starts.
If a more extensive service is required, the client may be offered the option to pay the difference.
If a less extensive service is appropriate, Dutch HR Bestie may move the client to that service and refund the price difference.
If the client does not wish to proceed, applicable statutory cancellation and withdrawal rights remain unaffected.
6. Information and documents supplied by the client
The client is responsible for providing information that is accurate, complete and sufficiently relevant for Dutch HR Bestie to perform the service.
The client remains responsible for checking that all requested materials have been supplied.
For privacy reasons, clients must remove or redact personal data of third parties where that information is not necessary for the requested analysis.
Clients must not send unnecessary sensitive information, including:
- BSN numbers;
- copies of passports, identity cards or residence documents;
- passwords or login credentials;
- banking credentials;
- full medical records;
- medical reports or diagnostic documents; or
- other sensitive personal data that is not necessary to understand the workplace question.
For sick-leave or health-related workplace situations, the client may explain the employment-related facts necessary to understand the HR situation but should not submit medical files or detailed medical evidence.
The client is responsible for anonymising documents before sending them to Dutch HR Bestie.
Dutch HR Bestie may ask the client to remove or resend documents if they contain unnecessary sensitive information.
Further information about the handling of personal data is provided in the Dutch HR Bestie Privacy Policy.
7. Delivery
The normal delivery period for Get In and Handle is a maximum of five working days.
The five-working-day period starts only once:
- payment has been completed; and
- Dutch HR Bestie has received all information and documents reasonably required to start the analysis.
Documents and additional information may be supplied by replying to the confirmation or intake email, unless another submission method is provided.
Dutch public holidays and weekends are not working days.
If additional information is necessary to complete the service, the delivery period may be paused until that information is received.
If Dutch HR Bestie is unable to meet the expected delivery period because of illness, technical disruption, force majeure or another circumstance outside reasonable control, the client will be informed and a new reasonable delivery date will be proposed. Mandatory consumer rights concerning late performance remain unaffected.
8. Statutory right of withdrawal
Consumers purchasing a service online generally have a statutory withdrawal period of 14 days from the conclusion of the agreement.
Dutch HR Bestie will provide the legally required withdrawal information before purchase.
Because Get In and Handle are normally delivered within five working days, clients may separately and expressly request Dutch HR Bestie to begin performing the service before the 14-day withdrawal period has ended.
The client will be asked to expressly acknowledge that:
- Dutch HR Bestie may begin performing the service before the end of the withdrawal period;
- if the client withdraws after performance has started but before the service has been fully performed, the client may be required to pay a proportionate amount for the work already performed; and
- where the service has been fully performed during the withdrawal period, the statutory right of withdrawal may end if all legal requirements for that loss of the withdrawal right have been satisfied.
Consent to the Terms & Conditions is separate from this request for early performance.
The early-performance consent must be given actively by the client and will not be pre-selected.
Dutch HR Bestie will confirm the client’s agreement to early performance in the purchase confirmation or another durable written confirmation.
A client wishing to exercise a statutory right of withdrawal may do so using the withdrawal function available on dutchhrbestie.com or by sending another clear statement of withdrawal to hi@dutchhrbestie.com.
Where legally required, Dutch HR Bestie will refund amounts due following a valid withdrawal within the applicable statutory period.
Nothing in these Terms limits rights that cannot legally be excluded.
9. Cancellation after work has started
Outside or in addition to statutory withdrawal rights, Dutch HR Bestie may charge for work reasonably performed before cancellation where permitted by law.
The amount retained will reflect the work actually performed and reasonable demonstrable costs incurred.
Dutch HR Bestie will not automatically retain the entire purchase price solely because an order was placed.
Where no substantive work has started, only reasonable costs actually incurred may be deducted where the law permits this.
10. Failure to provide the required information
Dutch HR Bestie cannot complete Get In or Handle without sufficient cooperation from the client.
If the client has not provided the information reasonably required to start the service within 30 days after purchase, Dutch HR Bestie may send a reminder.
If the required information remains outstanding after 90 days, Dutch HR Bestie may send a final reminder and provide a reasonable final deadline to complete the intake.
If the client still fails to provide the required information within that final period, Dutch HR Bestie may close and terminate the order because the service cannot be performed without the client’s cooperation.
Where an order is terminated for this reason, Dutch HR Bestie may retain a reasonable amount corresponding to work already performed and demonstrable costs incurred. Any remaining amount that the client is legally entitled to receive will be refunded.
A closed order cannot automatically be reactivated at a later date. The client may need to place a new order at the price applicable at that time.
11. Completion of the service
For Get In, the commissioned analysis is completed when the personalised PDF report has been sent to the client.
Get In does not include post-delivery follow-up unless separately agreed.
For Handle, the principal analysis is delivered when the personalised PDF report has been sent.
The included follow-up option allows one clarification question relating directly to that report within 14 days. It does not reopen the original analysis or create an ongoing advisory relationship.
A request concerning new circumstances, new substantive documents or a materially different issue may require a new service.
12. No guaranteed outcome
Dutch HR Bestie provides professional analysis and guidance, not guaranteed outcomes.
Get In does not guarantee:
- an interview;
- a response from an employer;
- an offer;
- a job;
- sponsorship;
- a particular salary; or
- success in any recruitment process.
Handle does not guarantee:
- a specific response from a manager, HR department or employer;
- a salary increase;
- a promotion;
- continuation of employment;
- a particular outcome of a workplace process;
- resolution of a conflict;
- a particular legal outcome; or
- any action by a third party.
Advice is based on the information available at the time and on the information supplied by the client.
The client remains responsible for their own decisions, actions, communications, applications, deadlines and professional or legal choices.
13. Accuracy and changing circumstances
Dutch HR Bestie takes reasonable professional care when preparing reports and aims to provide accurate and current HR-side guidance.
Employment circumstances, company policies, collective labour agreements, legislation and individual facts can change.
A report reflects the information and context available when it is prepared.
Dutch HR Bestie is not responsible for an incorrect or incomplete conclusion caused by relevant facts being withheld, misstated or supplied only after the report has been completed.
Where formal legal rights or obligations need to be established, the client should seek appropriately qualified legal advice.
14. Refunds after delivery
A client is not entitled to a refund solely because:
- they disagree with Dutch HR Bestie’s professional assessment;
- an employer does not act as the client hoped;
- an application does not lead to an interview or job;
- a salary negotiation is unsuccessful; or
- the advice does not produce the outcome preferred by the client.
This provision applies only where the service has been properly delivered and does not limit any mandatory statutory rights regarding defective or non-conforming performance.
Where Dutch HR Bestie fails to provide the agreed service, statutory consumer remedies remain available.
15. Intellectual property and permitted use
Unless expressly agreed otherwise, all intellectual property rights in Dutch HR Bestie reports, templates, layouts, frameworks, methodologies, graphics, written materials and generic content remain with Dutch HR Bestie.
The client receives a personal, non-exclusive right to use their report for their own situation.
The client may share their report where reasonably necessary with:
- their partner;
- their employer;
- their lawyer;
- their trade union;
- their legal insurer; or
- another relevant professional adviser.
The client may make copies reasonably necessary for those permitted purposes.
Without prior written permission from Dutch HR Bestie, the client may not:
- sell or resell a report;
- publish it publicly;
- upload it to a public website or platform;
- commercially distribute it;
- substantially reproduce it for third parties;
- remove branding and present the work as their own;
- use Dutch HR Bestie templates or methodology to create a competing commercial product; or
- otherwise exploit the material commercially.
Nothing in this Article limits rights granted by mandatory copyright law.
16. Confidentiality and personal information
Dutch HR Bestie will treat client information with appropriate confidentiality and will process personal data in accordance with the applicable Privacy Policy and data-protection law.
Clients should not submit confidential information through Instagram, TikTok, YouTube or other public/social-media messaging functions.
Client documents and case details should be sent only using the communication or intake method designated by Dutch HR Bestie.
Dutch HR Bestie may use anonymised learnings or general recurring themes to improve services or educational content only where no individual client can reasonably be identified.
Identifiable testimonials, case studies or client stories will not be published merely because the client purchased a service. Where consent is required, it will be requested separately.
17. Complaints
Clients are requested to report a complaint about a delivered service as soon as reasonably possible and preferably within 14 days after delivery so that Dutch HR Bestie can investigate the matter promptly.
Complaints may be sent to:
hi@dutchhrbestie.com
Dutch HR Bestie aims to provide a substantive response within 14 days after receiving the complaint.
If additional investigation is required, the client will be informed.
The request to complain within 14 days does not remove or reduce any mandatory statutory consumer rights.
18. Liability
Dutch HR Bestie is responsible for performing the agreed service with reasonable professional care.
To the extent permitted by mandatory law, Dutch HR Bestie is not liable for loss caused by:
- decisions independently made by the client;
- an employer, recruiter, government body or other third party;
- information supplied by the client that is incorrect, incomplete or outdated;
- failure by the client to meet their own application, employment, legal or other deadlines;
- outcomes that were never guaranteed under the agreement; or
- use of the report for a purpose outside the agreed service.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory law.
In particular, these Terms do not exclude liability for intentional misconduct or other liability that cannot legally be excluded.
19. Third-party services
Payments, email delivery, website functionality or other parts of the customer journey may rely on third-party service providers.
Those providers may apply their own privacy and technical terms.
Dutch HR Bestie remains responsible for its own obligations to the client but is not responsible for temporary disruption caused exclusively by a third-party system where Dutch HR Bestie could not reasonably prevent that disruption.
Where such disruption affects delivery, Dutch HR Bestie will take reasonable steps to restore or provide an alternative method of service.
20. Changes to these Terms
Dutch HR Bestie may update these Terms from time to time.
The Terms applicable to an individual purchase are the version made available to the client when that purchase was concluded, unless a later change is required by mandatory law or the client expressly agrees otherwise.
A new version will not retroactively reduce a consumer’s rights under an existing order.
21. Governing law
These Terms and agreements with Dutch HR Bestie are governed by Dutch law.
For consumers living outside the Netherlands, this choice of law does not remove mandatory consumer protection that applies to them under applicable international or European private law.
Disputes will be submitted to the competent court in accordance with applicable law.
Nothing in this Article limits a consumer’s mandatory right to bring proceedings before another competent court where such right applies.
